EXTENSION OF INTERIM ORDER SUSPENDING LICENCE

Warden Wellness Centre Ltd. ("Warden Wellness”) is licensed as a service provider (licence #SP18987) under the Act. This licence was granted on December 20, 2023. Anusuya Gobinathan is the principal representative of Warden Wellness.

On September 11, 2024, by delegated authority from the Chief Executive Officer of the Financial Services Regulatory Authority of Ontario (the “Chief Executive Officer”), the Director, Litigation and Enforcement (the “Director”) issued a Notice of Proposal (“Notice”) to revoke the service provider’s licence issued to Warden Wellness.

On September 11, 2024, the Director, by delegated authority from the Chief Executive Officer, issued an interim order immediately suspending the service provider’s licence issued to Waden Wellness.

On September 20, 2024, Warden Wellness requested a hearing by the Financial Services Tribunal with respect to the Notice.

ORDER

IT IS ORDERED THAT pursuant to section 288.6 of the Act, the interim suspension order dated September 11, 2024, against Warden Wellness, is extended until the Notice is finally determined.

AND TAKE NOTICE THAT pursuant to subsections 447(2)(b) and subsection 447(3) of the Act, every person who fails to comply with an order made under the Act is guilty of an offence and every person convicted of an offence under the Act is liable to a fine of not more than $250,000.00 on a first conviction and a fine of not more than $500,000 for each subsequent conviction.

Pursuant to subsection 447(4) of the Act, if a corporation commits an offence under the Act, every director or officer who directed, authorized, permitted or participated in the commission of the offence, or who failed to take reasonable care to prevent the corporation from committing the offence, is guilty of an offence, whether or not the corporation is prosecuted or convicted and is liable to a fine of not more than $100,000 on a first conviction and a fine of not more than $200,000 for each subsequent conviction.
