NOTICE OF PROPOSAL TO SUSPEND LICENCE

TO: Reditha Castillejos

TAKE NOTICE THAT pursuant to sections 392.5 and 407.1 of the Act, and by delegated authority from the Chief Executive Officer of the Financial Services Regulatory Authority of Ontario (the “Chief Executive Officer” or “FSRA”), the Director, Litigation and Enforcement, (the “Director”) is proposing to suspend the insurance agent licence issued to Reditha Abila Castillejos until she complies with a Notice of Examination issued under Section 443 of the Act and responds completely to the inquiries of the Chief Executive Officer.

Details of these contraventions and reasons for this proposal are described below. This Notice of Proposal includes allegations that may be considered at a hearing.

REASONS FOR PROPOSAL

I. INTRODUCTION

  1. These are the reasons for the proposal by the Director to suspend the insurance agent licence issued to Reditha Abila Castillejos (“Castillejos”) until she:
    1. complies with the Notice of Examination dated June 12, 2025 (the “Notice of Examination”); and
    2. responds completely to the inquiries of the Chief Executive Officer.
  2. An agent who fails to facilitate an examination or investigation and fails to answer an inquiry hinders FSRA’s ability to investigate potential non-compliance and to protect the public.

II. BACKGROUND

A. FSRA Licensing History

  1. Castillejos has been licensed as a life insurance and accident & sickness insurance agent (licence # 02072076) under the Act since June 26, 2002. Castillejos’ licence is scheduled to expire on October 23, 2026.

B. FAILURE TO PROVIDE INFORMATION REQUESTED BY FSRA

2025 Warning Letter
  1. On May 29, 2025, FSRA issued a warning letter to Castillejos for failing to respond to information requests in connection with a consumer complaint (the “Warning Letter”).
Failure to Respond to Notice of Examination and FSRA Inquiries
  1. On June 12, 2025, FSRA sent Castillejos a Notice of Examination requiring her to complete the Life and Health Insurance Agent Market Conduct Questionnaire (the “Questionnaire”) by June 26, 2025. FSRA provided instructions on how to access the Questionnaire and cautioned Castillejos on potential enforcement action for not completing the Questionnaire on time.
  2. On June 18, 2025, in a telephone conversation with FSRA Staff, Castillejos confirmed receipt of the Notice of Examination.
  3. On June 26, 2025, Castillejos contacted FSRA by email about a technical issue she was facing with the Questionnaire. In July 2025 FSRA requested further details. Castillejos did not respond.
  4. On July 28, 2025, FSRA directed Castillejos to complete and submit the Questionnaire by August 1, 2025. Castillejos failed to complete and submit the Questionnaire by the deadline. FSRA extended the deadline to August 11, 2025. Despite several attempts by FSRA to contact her, Castillejos again failed to comply or respond.
  5. On September 4, 2025, FSRA sent an email to Castillejos asking that she confirm her involvement in a civil case and provide details of the same by September 19, 2025 (the “September 2025 Inquiry”). Castillejos did not respond.
  6. On September 25, 2025, FSRA sent a letter to Castillejos advising her, among other things, of her statutory duty to provide information in response to FSRA’s inquiries. Castillejos did not respond to the letter.
  7. On October 20, 2025, FSRA sent a final letter to Castillejos advising her of consequences for her non-responsiveness. Castillejos did not respond to the letter.
  8. FSRA sent all communications to Castillejos using the contact information she provided to FSRA.

III. CONTRAVENTIONS OR FAILURES TO COMPLY WITH THE ACT

A. Duty to Provide Information

  1. Pursuant to s. 443(1) of the Act, it is a condition of the licensing of a person that the person facilitate examinations. Section 443(2) requires that licensees comply with the person conducting the examination in the manner and within the period specified.
  2. Subsection 442.3(1) of the Act requires that a person to whom an inquiry is directed must answer promptly, explicitly and completely, and in the manner and period specified.
  3. The Director is satisfied that Castillejos did not comply with her obligations under the Act. She failed to comply with the Notice of Examination, failed to complete and submit the Questionnaire, and failed to respond to the September 2025 Inquiry.

IV. GROUNDS FOR THE PROPOSAL

A. Grounds to Suspend Castillejos’ Licence

  1. Section 392.5(1) of the Act states that the Chief Executive Officer may revoke or suspend an agent’s licence to act as an insurance agent, if the agent has failed to comply with the Act, the regulations, or a condition of the licence.
  2. Castillejos has demonstrated a pattern of failing to facilitate and comply with FSRA examinations and provide information as required under the Act. Castillejos was provided with multiple opportunities to comply with her obligations and was warned of the consequences for non-compliance.
  3. The examination process provided under section 443 of the Act is a critical tool for FSRA to ensure that a licensee’s business and business processes are compliant with the Act and industry standards that protect consumers. Licensed agents are obliged to respond to and comply with a Notice of Examination and undergo the examination process promptly and completely.
  4. Licensed agents are also obliged to answer regulatory inquiries promptly, explicitly, and completely, and to answer in the manner and period specified.
  5. Castillejos’ conduct prevents FSRA from performing its gatekeeper function and reviewing her suitability to be licensed under the Act. For these reasons, and such further and other reasons as may come to the attention of the Director, the Director proposes to suspend Castillejos’ licence until she has explicitly and completely responded to and complied with the Notice of Examination and the September 2025 Inquiry.
